These terms explain the rules for using songbyheart.com and ordering a song. By using the site or placing an order, you agree to them. If you do not agree, please do not use the service.

Who can use songbyheart

You must be at least 18 and able to enter a contract. You agree to give information that is true as far as you know, and to use the service for lawful, personal purposes.

What we provide

songbyheart helps you turn a story you share into an original song, and optional extras such as a gift page or cover art. Songs are created with a mix of human process and automated tools, including AI.

Times such as “ready in minutes” or “usually within a day” are estimates, not a promise. We will try to keep you updated if something is delayed.

Your story

You keep the rights you already have in the words, photos, and details you send us. You give us permission to use that material to create, deliver, host, and support your order.

Do not send anything you do not have the right to use. Do not include other people’s private information without their okay. Do not ask us to create anything illegal, hateful, or that impersonates someone in a harmful way. We may refuse or cancel an order that breaks these rules.

Your song

When you pay for an order, we give you a personal licence to play, download, and share that song as a gift. That includes sending the link or file to the person it is for, and playing it at a private event.

This licence is not a transfer of every possible right in the recording. Please ask us first if you want to:

• Sell the song, stream it as a commercial release, or use it in an ad
• Register it with a music publisher or collection society
• Use it as the official soundtrack for a film, brand, or public campaign

AI-made music can sometimes resemble other work. We do not promise that a song is unique in every possible way, or that it will suit a commercial release.

Payment

Prices shown at checkout are in the currency displayed there and include any extras you add. You pay when you place the order. Digital items are made to your request, so usual “change of mind” cooling-off rules may not apply — see our refunds page.

If something goes wrong

If a song does not generate, arrives damaged, or is clearly not what you asked for, email us and we will try to fix it or refund you. Nothing here takes away rights you already have under consumer law where you live.

The site

We try to keep the site available, but we do not guarantee it will always be up or error-free. We may change or pause the service. Sample songs, portraits, and ratings on the site are examples unless we say they are real customer reviews.

To the extent the law allows, we are not responsible for losses we could not reasonably foresee, or for how someone else reacts to a song you send them.
